Thomas Coburn - Legal Brief

On March 25, 2010, the Thompson Coburn law firm submitted its legal opinion to Missouri State Senator Jason Crowell at the behest of the Board of Trustees of the Missouri State Employees’ Retirement System. The 26-page document accompanies this introduction. The opinion predicts the probable legal outcome if the Missouri Legislature changes the pension systems covering state employees, including members of MOSERS and MPERS.

ARMSE is posting this document on our web site for the benefit of members and non-members alike. As a retiree, this reader found the opinion interesting, understandable, and reassuring. For those readers who are still actively employed, be sure to read page 24 of the brief. Section C, entitled “Offsetting Benefits”, discusses how the court could be predicted to look at the subject of matching future salary increases with future member contributions. I believe this section comes closest to describing how the Missouri Legislature could change the pension system for those still currently employed.
